Facility: Selamberr Dive Training Pool, Dengkil
Activity: Diving training, scuba practice, freediving practice, swimming-related training, underwater skills practice, equipment testing, photography/videography, and other approved pool activities.
Applies to: All divers, students, instructors, coaches, dive centres, guests, visitors, photographers, videographers, assistants, and any person entering or using the pool facility.
1. Acceptance of Terms
By making a booking, entering the premises, using the pool, participating in any activity, or signing this agreement, I confirm that I have read, understood, accepted, and agreed to comply with all Pool Rules & Liability Terms issued by Selamberr Dive Training Pool.
I understand that these terms apply before, during, and after my use of the pool facility, including while I am within the premises, changing area, waiting area, equipment area, pool deck, and any other area managed or controlled by Selamberr Dive Training Pool.
I acknowledge that failure to comply with these terms may result in refusal of entry, cancellation of booking, removal from the premises, suspension from future bookings, forfeiture of fees, and/or further action where applicable.
2. Assumption of Risk
I understand and acknowledge that diving, scuba training, freediving, swimming, underwater activities, and related training involve inherent risks, including but not limited to:
a. drowning, near-drowning, panic underwater, breath-holding blackout, lung over-expansion injury, ear or sinus injury, barotrauma, decompression-related risk where applicable, equipment failure, loss of buoyancy control, impact injury, slipping, falling, collision, muscle cramps, exhaustion, dehydration, illness, allergic reaction, medical emergency, injury caused by other participants, and death;
b. risks caused by water conditions, pool depth, pool edges, ladders, steps, wet surfaces, underwater structures, training props, lighting, weather, power failure, emergency situations, or unforeseen incidents;
c. risks arising from personal health conditions, lack of skill, lack of fitness, failure to follow instructions, misuse of equipment, negligence by myself or other participants, or failure to disclose relevant medical information.
I voluntarily choose to participate in these activities with full knowledge of the risks involved.
3. Health, Fitness & Medical Declaration
I declare that I am physically and mentally fit to participate in diving, swimming, or pool-based training activities.
I confirm that I do not have any medical condition that may affect my safety or the safety of others, including but not limited to heart disease, asthma, epilepsy, respiratory illness, fainting episodes, panic attacks, uncontrolled diabetes, recent surgery, serious allergies, pregnancy-related risk, ear/sinus problems, or any condition that may impair my ability to safely enter the water.
If I have any medical condition, answer βYesβ to any relevant diving medical screening question, feel unwell, or am unsure about my fitness to dive or swim, I agree to obtain clearance from a qualified medical practitioner before participating.
I agree not to enter the pool if I am under the influence of alcohol, drugs, medication causing drowsiness, or any substance that may impair my judgment, coordination, or safety.
Divers are commonly required by dive operators to obtain physician clearance where medical screening raises concerns before recreational diving or freediving activity. That is sensible because apparently lungs and water have a rather unforgiving relationship.
4. Certification, Training Level & Supervision
I agree to participate only in activities suitable to my certification level, training level, experience, and physical ability.
If I am a student or uncertified diver, I must be supervised by a qualified instructor, divemaster, coach, or authorized person approved by Selamberr Dive Training Pool.
If I am an instructor, coach, divemaster, or representative of a dive centre, I accept full responsibility for supervising my students, clients, guests, or team members during the booking period.
I shall not conduct training, coaching, classes, commercial activities, photography sessions, videography sessions, or equipment testing without prior approval from Selamberr Dive Training Pool.
5. Pool Safety Rules
All users must comply with the following pool safety rules:
a. Follow all instructions given by Selamberr Dive Training Pool staff, safety personnel, instructors, coaches, or authorized representatives.
b. Attend safety briefing before entering the pool where required.
c. No running, pushing, rough play, fighting, shouting excessively, horseplay, or unsafe behaviour within the premises.
d. No diving, jumping, or entering the water without permission or outside designated entry points.
e. No breath-hold training, static apnea, dynamic apnea, freediving drills, rescue drills, deep-water practice, or high-risk underwater activity without proper supervision.
f. No solo diving or solo underwater activity unless specifically approved.
g. Buddy system must be used where required.
h. No tampering with pool equipment, safety equipment, pumps, filters, electrical systems, ladders, signage, ropes, barriers, emergency devices, or any facility property.
i. Keep pool deck, entry points, exits, and emergency access clear at all times.
j. Report unsafe conditions, accidents, injuries, illness, damaged equipment, or suspicious behaviour immediately to pool staff.
k. Children, minors, and non-swimmers must be supervised at all times by a responsible adult or authorized instructor.
l. Selamberr Dive Training Pool reserves the right to stop any activity that is considered unsafe, disruptive, or unsuitable.
6. Equipment Responsibility
I am responsible for ensuring that all equipment used by me is complete, suitable, properly maintained, correctly fitted, and safe for use.
This includes but is not limited to mask, snorkel, fins, BCD, regulator, tank, weights, wetsuit, exposure suit, dive computer, gauge, camera equipment, underwater props, lighting, and any personal or rented equipment.
I agree to inspect my equipment before entering the pool and immediately stop using any equipment that is faulty, leaking, damaged, unsafe, or unsuitable.
If I use rented, borrowed, or third-party equipment, I accept responsibility for checking its condition before use and returning it in the same condition, fair wear and tear excepted.
I agree to pay for any loss, damage, breakage, cleaning, repair, replacement, or additional cost caused by my negligence, misuse, improper handling, or failure to follow instructions.
7. Damage to Property
I agree to be responsible for any damage, loss, or destruction caused by me, my students, my guests, my team, my equipment, or any person under my supervision.
This includes damage to the pool, tiles, ladders, glass, furniture, lockers, changing rooms, toilets, signage, electrical fixtures, lights, pumps, filters, rented equipment, training equipment, safety equipment, and any property belonging to Selamberr Dive Training Pool or other users.
Selamberr Dive Training Pool reserves the right to charge repair, replacement, cleaning, administrative, or recovery costs where applicable.
8. Personal Belongings
I am fully responsible for my own personal belongings, including bags, wallets, phones, watches, jewellery, cameras, dive computers, documents, money, vehicles, and any equipment brought into the premises.
Selamberr Dive Training Pool shall not be responsible for loss, theft, misplacement, or damage to personal belongings unless caused directly by proven misconduct or gross negligence of the facility.
Users are advised not to bring unnecessary valuables into the premises.
9. Emergency, First Aid & Medical Treatment
In the event of an emergency, accident, injury, illness, panic, blackout, suspected drowning, or any unsafe situation, I authorize Selamberr Dive Training Pool, its staff, instructors, coaches, or authorized representatives to take reasonable emergency action.
This may include first aid, rescue response, CPR, calling ambulance services, contacting emergency contacts, moving me to a safer location, or arranging medical assistance.
I understand that Selamberr Dive Training Pool staff or representatives may not be medical professionals, and any assistance provided is given in good faith during an emergency.
I agree that I am responsible for any medical, ambulance, hospital, transport, treatment, recovery, or related costs incurred as a result of my participation, unless covered by applicable insurance or otherwise required by law.
10. Insurance
I understand that Selamberr Dive Training Pool may maintain certain insurance coverage, including facility-related or public liability insurance, subject to the terms, exclusions, limits, and conditions of the relevant insurance policy.
I understand that such insurance may not cover all injuries, losses, damages, personal belongings, medical costs, diving-related incidents, professional training activities, negligence by third parties, personal health conditions, or activities outside the approved scope.
I am strongly advised to maintain my own personal accident insurance, medical insurance, diving insurance, travel insurance, or professional liability insurance where applicable.
If I am an instructor, coach, divemaster, dive centre operator, photographer, videographer, event organizer, or commercial user, I confirm that I am responsible for ensuring my own professional, public liability, or activity-related insurance coverage where required.
11. Release, Waiver & Limitation of Liability
To the fullest extent permitted by Malaysian law, I agree that Selamberr Dive Training Pool, its owners, directors, employees, staff, contractors, agents, representatives, partners, instructors, coaches, landlords, and affiliates shall not be liable for any injury, illness, death, loss, damage, cost, claim, or expense arising from my voluntary participation in pool activities, except where such liability cannot be excluded by law.
This includes claims arising from inherent risks of diving, swimming, underwater activity, training, personal health conditions, my own negligence, failure to follow rules, misuse of equipment, actions of other participants, or circumstances beyond reasonable control.
I understand that this waiver does not exclude liability where the law does not allow exclusion, including proven gross negligence, wilful misconduct, fraud, or any liability that cannot legally be waived.
I agree to release, waive, and discharge Selamberr Dive Training Pool from claims arising from ordinary risks associated with the activity, to the extent permitted by law.
12. Indemnity
I agree to indemnify and hold harmless Selamberr Dive Training Pool, its owners, directors, employees, staff, contractors, agents, representatives, partners, instructors, coaches, landlords, and affiliates from any claim, demand, loss, damage, liability, cost, or expense arising from:
a. my breach of these terms;
b. my negligence, misconduct, or unsafe behaviour;
c. my failure to follow instructions;
d. my failure to disclose medical or safety-related information;
e. damage caused by me or my equipment;
f. injury or loss caused to another person by me;
g. claims made by my students, guests, team members, clients, minors, or any person under my supervision;
h. unauthorized commercial activity, training, filming, photography, or event use.
13. Minors
Participants below 18 years old must have consent from a parent or legal guardian.
The parent or legal guardian confirms that the minor is fit and able to participate safely and agrees to be responsible for the minorβs compliance with these terms.
The parent or legal guardian accepts responsibility for any loss, injury, damage, claim, cost, or liability arising from the minorβs participation, to the extent permitted by law.
A minor must be supervised at all times by a parent, guardian, qualified instructor, coach, or authorized person.
14. Conduct & Facility Use
I agree to behave respectfully and responsibly at all times.
The following are strictly prohibited:
a. alcohol, drugs, smoking, vaping, or prohibited substances within restricted areas;
b. abusive, threatening, discriminatory, aggressive, or inappropriate behaviour;
c. harassment of staff, instructors, divers, guests, or other users;
d. unauthorized access to restricted areas;
e. misuse of toilets, changing rooms, lockers, safety equipment, or facility property;
f. littering or leaving equipment in unsafe areas;
g. bringing hazardous, sharp, flammable, or dangerous items without approval;
h. any activity that may endanger others or damage the facility.
Selamberr Dive Training Pool reserves the right to remove any person who breaches these rules without refund.
15. Photography, Videography & Media
Photography and videography are only allowed with prior approval from Selamberr Dive Training Pool and must not disturb other users or compromise safety.
Users must obtain consent before recording, photographing, or publishing images/videos of other participants, staff, minors, instructors, or private sessions.
Selamberr Dive Training Pool may use CCTV or other monitoring systems for safety, security, operational, and incident investigation purposes.
By entering the premises, I acknowledge that I may be recorded by CCTV for safety and security purposes.
For promotional photography or videography by Selamberr Dive Training Pool, separate consent may be requested where required.
16. Booking, Payment, Cancellation & Refund
Bookings are subject to availability, confirmation, payment, and compliance with Selamberr Dive Training Poolβs booking procedures.
Selamberr Dive Training Pool reserves the right to cancel, reschedule, suspend, or refuse a booking due to safety concerns, weather, maintenance, emergency, operational issues, misuse of facility, non-compliance, or circumstances beyond reasonable control.
Refunds, postponements, and cancellations are subject to Selamberr Dive Training Poolβs booking policy.
No refund may be given if a user is refused entry or removed due to breach of rules, unsafe conduct, late arrival, non-compliance, false declaration, or failure to meet required conditions.
17. Force Majeure, Disaster & Unforeseen Events
Selamberr Dive Training Pool shall not be liable for delay, cancellation, closure, loss, injury, damage, or failure to provide access caused by events beyond reasonable control.
This includes but is not limited to flood, fire, lightning, storm, haze, earthquake, pandemic, government order, power failure, water supply issue, contamination, equipment breakdown, riot, civil disturbance, accident, security threat, or any emergency situation.
Selamberr Dive Training Pool may close the facility immediately if continued operation is considered unsafe.
18. Compliance with Laws & Directions
All users must comply with applicable Malaysian laws, local authority requirements, health and safety rules, emergency directions, and facility policies.
Selamberr Dive Training Pool reserves the right to update these terms, rules, fees, operating hours, booking procedures, and safety requirements from time to time.
The latest version published on the website or displayed at the facility shall apply.
19. Privacy & Personal Data
I consent to Selamberr Dive Training Pool collecting, storing, and using my personal information for booking, attendance, safety, emergency contact, payment record, incident report, insurance-related processing, legal compliance, and operational purposes.
Personal information may include name, identification/passport number, contact number, email, emergency contact, medical declaration, certification level, booking details, signature, CCTV footage, and incident records.
Selamberr Dive Training Pool shall take reasonable steps to protect personal data and shall not disclose it except where necessary for operations, emergency response, insurance, legal compliance, investigation, or with consent.
20. Declaration
I confirm that:
a. I have read and understood these Pool Rules & Liability Terms;
b. I have had the opportunity to ask questions before signing or agreeing;
c. all information provided by me is true and accurate;
d. I am fit to participate;
e. I understand the risks involved;
f. I voluntarily agree to participate;
g. I agree to follow all rules and instructions;
h. I accept responsibility for my own safety, belongings, equipment, conduct, and any person under my supervision;
i. I agree to the waiver, release, limitation of liability, and indemnity terms stated above.
